NovaCasa Virtual Office Website Terms of Use
These Terms govern registered Virtual Office Website (VOW) access to MLS listing information through Just Ask Nestor, operated by NovaCasa Realty. They are NovaCasa Realty terms and are not represented as approved by Charleston Trident MLS or any other MLS.
Purpose and consumer-broker relationship
VOW access is available only to a registrant who acknowledges entering into the lawful consumer-broker relationship required for VOW access. These Terms describe conditions for MLS/VOW data access only. They do not themselves create a representation agreement; any representation or transaction agreement is presented separately.
Personal, non-commercial use
MLS/VOW data is provided solely for your personal, non-commercial use in connection with a bona fide interest in purchasing, selling, or leasing real estate of the type offered through this VOW.
Permitted property consideration
You may use displayed MLS/VOW data only as reasonably necessary to consider an individual property. You may not use it for commercial, research, advertising, solicitation, data-collection, or other unrelated purposes.
Restrictions on MLS data
You may not copy, redistribute, retransmit, scrape, archive, download in bulk, or otherwise misuse MLS data except as permitted in connection with consideration of an individual property. You may not circumvent technical controls that protect MLS/VOW data.
MLS ownership and copyright
You acknowledge the MLS ownership of and copyright interest in its MLS database and MLS data. Display through this VOW does not transfer ownership, copyright, or any license beyond the limited personal-use permission in these Terms.
Compliance access and monitoring
You expressly authorize Charleston Trident MLS, other authorized MLS participants, and their representatives to access this VOW for compliance verification and monitoring. NovaCasa Realty may monitor use and suspend or terminate VOW access when required by applicable MLS rules or to protect MLS data.
Access duration, expiration, and renewal
VOW access remains subject to applicable MLS rules, these Terms, and any expiration or renewal requirement shown by NovaCasa Realty. Expired access remains unavailable until properly renewed. A new or substantively changed Terms version must be reviewed and affirmatively accepted before VOW access under that version is provided.
Separate financial and transaction agreements
These Terms do not impose an Offer Tools subscription, a transaction fee, or any other financial obligation. They are separate from the $9.99/month Offer Tools subscription, any $599 transaction-fee authorization, and any NovaCasa Transaction Brokerage Agreement.
